Commencement – Vice-Chairman Napoli called the meeting to order at 7:20 p.m. and explained meeting procedure.

ANR Plan – 123 Allen’s Point Road, c/o Alan Minard
Mr. Minard was present for the meeting.  Two lots exist at the site and the plan will not result in any additional lots.      

Moved by Member Ryder and seconded by Member Crowley to endorse the plan as submitted.  VOTE:  6-0-0

Moved by Member McArdle and seconded by Member Ryder to open the public hearing for Shaw/Johnson, 404 & 406 Point Road.  VOTE:  6-0-0
Public Hearing – Special Permit Request – Shaw/Johnson – 404 & 406 Point Road, c/o Attorney Richard Schaefer
Moved by Member McArdle and seconded by Member Ryder to open the public hearing.  VOTE:  6-0-0
The public hearing notice was read into the record.  The applicant has requested that the public hearing be continued to the February 22 meeting at 7:30 p.m.
Moved by Member Ryder and seconded by Member Gonsalves to continue the public hearing to February 22 at 7:30 p.m.  VOTE:  6-0-0

Moved by Member McArdle and seconded by Member Ryder to close the public hearing for the Special Permit Request by Shaw/Johnson.  VOTE:  6-0-0

Old/New Business
Approval of Minutes
Moved by Member McArdle and seconded by Member Ryder to approve the minutes of the January 4, 2010 meeting as submitted.  VOTE:  6-0-0

Moved by Member McArdle and seconded by Member Gonsalves to approve the minutes of the January 11, 2010 meeting as amended (change signature line).  VOTE:  6-0-0

Discussion – 160 Front Street, Jill Houck
Property owner Neil Balboni was also present for this discussion.  
Ms. Houck told the Board she owns a small baking company and would like to open a bakery at 160 Front Street.  
After discussion Ms. Houck was advised to apply for a Special Permit allowing a retail use in a General Business district.        

Public Hearing – Amendment to Special Permit and Site Plan Approval – Sardinha Family Trust – 450 Wareham Street, c/o Merrill Associates
Moved by Member McArdle and seconded by Member Ryder to open the public hearing.  VOTE:  6-0-0
The public hearing notice was read into the record.  The applicant was represented by Jack O’Leary.  The request is to amend a condition of the Special Permit; the amended condition would allow a change in the background color of the sign (Raddichio Red to Jackson Tan).  Member Ryder said it was a good change.      

Moved by Member McArdle and seconded by Member Ryder to approve the change in the sign background color from Raddichio Red to Jackson Tan, with gold leaf lettering.  VOTE:  6-0-0  

Discussion – Alternative Energy Committee – Proposed bylaw amendment
Norm Hills and William Saltonstall were present on behalf of the Alternative Energy Committee to discuss amendments to Section 8.3 of the Zoning Bylaw.  

Moved by Member Crowley and seconded by Member McArdle to hold a public hearing for the proposed bylaw amendment on February 22 at 7:45 p.m.  VOTE:  6-0-0   
 
Discussion - Withdrawal of Special Permit application – Always in Bloom, 454 Wareham Street
NOTE:  Member Gonsalves and Member Ryder recused themselves from the following discussion and vote.  
The applicants have submitted a written request to withdraw the application for a Special Permit.  The request was read into the record.  

Moved by Member McArdle and seconded by Member Crowley to accept the applicant’s request to withdraw the application for a Special Permit at 454 Wareham Street (Always in Bloom flower shop.)  VOTE:  6-0-0

NOTE:  Member Gonsalves and Member Ryder rejoined the meeting.  

Discussion – Master Plan Update
This item will be placed on the February 22 meeting agenda.

Discussion – Comments to ZBA – Sardinha Family Trust, 454 Wareham Street
NOTE:  Member Gonsalves and Member Ryder did not participate in the following vote.  
The application was reviewed and discussed; draft comments composed by Chairman Magauran were discussed as well.  
Moved by Member Crowley and seconded by Member Sweeney to forward the comments submitted by Chairman Magauran to the ZBA.  VOTE:  4-0-0

Discussion – Comments to ZBA – Melissa Talbot & Sherri Leo, 313 Wareham Street
The application was reviewed and discussed.    
Moved by Member Gonsalves and seconded by Member Crowley to send comments to the ZBA voicing support for the application.  VOTE:  6-0-0
   
Moved by Member McArdle and seconded by Member Gonsalves to adjourn at 8:45 p.m.  VOTE:  6-0-0
